Course Description:


This is only for those who have outstanding Year 1 requirements. If you have completed your CLPD Year 1 requirements, please do not take this course as it will not be counted towards Year 2 CLPD mandatory requirements.   The curriculum has been designed to give Legal Consultants an overview of the Ethical Code in which all Legal Consultants should adhere to. These courses will discuss of the following: Legal Consultants should be able to demonstrate • Acting ethically. • Identify any relevant ethical dimension of a particular situation. • Take action, which complies with professional ethical standards in that situation. Discharging the legal duties and obligations of Advocates and Legal Consultants • Identify any duty or obligation imposed on the lawyer by law in a particular situation. • Discharge that duty or obligation according to law and the Code of Conduct. Complying with professional conduct rules • Identify any applicable rules of professional conduct. • Take action, which complies with those rules. Complying with fiduciary duties • Recognize and comply with any fiduciary duty, according to the Code of Conduct and Federal Law. Avoiding conflicts of interest • Identify any potential or actual conflict, as soon as is reasonable in the circumstances. • Take effective action to avoid a potential conflict or, where a conflict has already arisen, deal with it in accordance with law and good practice. • Take appropriate action, where applicable, to prevent such a conflict arising in the future. Accounting and Keeping Records • Ensure clients monies are protected and separated from firms. • Maintain books to international best practice. • Ensure firm keeps accurate receipts of all client monies.
